Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Volto website at https://joinvolto.com and our managed wedding guest photo collection and face-recognition service (together, the "Service"). Please read them carefully. By booking, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Agreement to terms

These Terms form a binding agreement between you and Volto, based in Newton, MA. If you are entering into these Terms on behalf of a couple, company, or other entity, you represent that you have authority to bind them, in which case "you" refers to that party.

The service

Volto provides a managed service that collects the photos your wedding guests take and delivers them to you in a single private gallery, typically within 48 hours of your event. Guests upload through a link, with no app or account required. Depending on your package, the Service may also include the optional "Find Yourself" face-search feature and physical keepsakes. Package contents, prices, and features are described on our Packages page and confirmed at the time of booking.

Eligibility

You must be at least 18 years old and able to form a binding contract to book the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and complete.

Booking, pricing & payment

Package prices are listed in U.S. dollars on our Packages page and are confirmed when you book. We may update our prices at any time, but the price confirmed for your booking is the price that applies to your event. Payment is handled through a third-party payment processor; by paying, you agree to that processor's terms in addition to ours. Unless stated otherwise at booking, your booking is confirmed once payment (or any required deposit) is received and we have confirmed your event date.

Cancellations & refunds

We want you to be comfortable booking. If you need to cancel, contact us as early as possible. Unless your booking confirmation states otherwise, you may cancel for a full refund up to 14 days before your event date; cancellations after that point may be non-refundable because we reserve capacity and prepare for your date in advance. If we are unable to deliver the core Service due to a failure on our side, we will work with you to make it right or provide a refund of amounts paid for the affected Service. Specific terms for your package will be confirmed at booking.

Your responsibilities

As the customer booking the Service, you agree to:

• Provide accurate event details and a valid way for us to reach you;
• Share your gallery link only with people you intend to invite to contribute or view photos;
• Inform your guests that photos are being collected through Volto and that the gallery may include an optional face-search feature, so guests can decide whether to participate. You are responsible for obtaining any consent or providing any notice required by the laws that apply to your event and guests, including any state biometric-privacy laws;
• Not use the Service for any unlawful purpose or in a way that infringes the rights of others.

Photos: ownership & license

Guests retain ownership of the photos they upload. By uploading photos to a gallery, a guest grants Volto a limited license to host, process, organize, and deliver those photos for the purpose of providing the Service to the couple, and grants the couple the right to view, download, and use the photos from their gallery. We do not claim ownership of your photos, and we will not use your or your guests' photos for our own marketing or promotion without your explicit permission. You and your guests are responsible for ensuring you have the right to upload the photos you submit.

Face recognition

The optional "Find Yourself" feature lets a guest upload a single selfie to find the photos they appear in. As described in our Privacy Policy, the guest's selfie is used only for that one search and deleted right after, while the faceprints that power the search are kept in a private, per-event index and deleted when the event is archived. Use of the feature is voluntary, and a guest who declines it can still view and download the gallery. Face recognition is provided on a best-effort basis and may not identify every photo of a person; see Disclaimers below.

Acceptable use

You agree not to, and not to allow others to:

• Upload content that is unlawful, infringing, defamatory, or that you do not have the right to share;
• Attempt to gain unauthorized access to galleries, accounts, or our systems;
• Interfere with, disrupt, or place undue load on the Service;
• Use the Service to harass, harm, or violate the privacy of others;
• Reverse engineer, scrape, or misuse any part of the Service except as permitted by law.

Intellectual property

The Volto name, logo, website, and all related content and software are owned by Volto and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or content except as necessary to use the Service as intended.

Third-party services

The Service relies on third-party providers for hosting, payment processing, analytics, and communications. We are not responsible for the acts or omissions of those providers, and your use of their features may be subject to their own terms and policies.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that every guest will upload photos, or that the face-search feature will find every photo of a given person. Delivery timeframes, including the 48-hour target, are estimates and not guarantees. The number and quality of photos depend on guest participation, which is outside our control.

Limitation of liability

To the fullest extent permitted by law, Volto and its owners and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, photos, profits, or goodwill, arising out of or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Volto from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, your failure to obtain any required guest consents or notices, or your infringement of the rights of any third party.

Governing law & disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the Service or these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts, unless applicable law requires otherwise. Nothing in these Terms limits any rights you may have that cannot be waived under applicable law.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Changes take effect when posted, and your continued use of the Service after that means you accept the updated Terms.
